This notice sets out how Happy Child Health will use your personal data as part of the medical services Happy Child Health provides to you (or in which you have indicated an interest). Please ensure that you have read and understood this notice and keep a copy for future reference.  

 

Happy Child Health may collect and hold the following personal data about you: your name, address, email address, phone number, date of birth, gender, details of next of kin/emergency contact information and medical records (which will include details of your health, including any medical conditions and sex life/sexual preferences to the extent this relates to any symptoms/clinical treatment we are discussing with you). To help us keep your data accurate and ensure that Happy Child Health can provide the highest quality service to you, please let us know if there are any changes to your personal data. 

 

Happy Child Health uses your personal data to provide our medical services to you, comply with our legal obligations and to send you details of available appointments and appointment reminders by your preferred contact method. Happy Child Health uses the personal data set out above to provide our medical services to you in accordance with the contract to provide medical services which we have with you (or to provide information about our services in contemplation of your entering into a contract with us) and to comply with our legal and regulatory obligations as a provider of medical services. Happy Child Health is a professional subject to an obligation of professional secrecy.

 

Happy Child Health may contact you by email (or post if you do not have an email address or do not wish us to use you email address for this purpose) to send you details of available appointments, reminders to book your regular health check and related information. 

 

You have a right to object to Happy Child Health sending you information. If you do object then we will not be able to send you details of available appointments, reminders to book your regular health check or related information. This may mean that you find it harder to find available appointments, miss out on suggested health and wellbeing actions.

 

Happy Child Health does not transfer any of your data outside of the European Economic Area.   

 

Happy Child Health will share some of your personal data with selected third party processors in order to provide our medical Services to you. This will include our IT service provider, our email platform provider and our document shredding provider who will process your personal data on our behalf.

 

Happy Child Health may also share some of your personal data with selected healthcare/wellbeing professionals, specialists and your NHS GP, with your consent. If, following consultation with you, Happy Child Health feels you may benefit from receiving the services of any third party healthcare/wellbeing professional, e.g. surgeons, nutritionists, dentists, physiotherapists etc., Happy Child Health may (with your consent) share some of your personal data with such third party as a referral so they can contact you about the services they may be able to provide to you. Happy Child Health will, on your request (and with your consent) share some of your personal data with your NHS GP. Where Happy Child Health shares your personal data with a third party who provides associated health/wellbeing services and/or your GP they shall also become a data controller in respect of your personal data and you should review their privacy policy to ensure that you are comfortable with their use of your personal data.

 

Happy Child Health may also be required by law or regulation to share your personal data with HM Revenue & Customs and other regulatory authorities although this will not include any of your medical records unless we notify you otherwise.

 

Happy Child Health will retain and process your personal data in accordance with industry guidance. Happy Child Health will continue to hold and use your personal data until your 26th birthday or 10 years after being seen, to ensure we comply with our legal obligations, good industry practice and to assist us in defending any potential claims. 

 

Happy Child Health have put in place appropriate security measures to protect your personal data from being accidentally lost, used or accessed in an unauthorised way, altered or disclosed. In addition, Happy Child Health limits access to your personal data to those employees, agents, contractors and other third parties who have a business need to know such information. These parties will only process your personal data on our instructions and they are subject to a duty of confidentiality. Details of your medical records are stored on a nationally recognised, secure (password protected), login only software system and your other personal data is stored in a locked electronic and/or physical file.

 

You have the following rights in respect of the personal data Happy Child Health holds about you: (i) a right of access to such data; (ii) a right to object to our processing for direct marketing purposes; (iii) a right (in certain circumstances) to request that your personal data be transferred to you or a third party; and (iv) a right (in certain circumstances) to have inaccurate personal data rectified, blocked, erased or destroyed. If you wish to exercise any of these rights, please contact us in writing. You also have a right to lodge a complaint with the Information Commissioner’s Office (ICO) but we request that you contact us before escalating any complaint to the ICO. 

 

Happy Child Health may update this policy from time to time to reflect changes in the way we use your personal data or legal/regulatory requirements. If we do update this policy, Happy Child Health will let you know by sending a copy of the updated policy to you.
